Description
Pursuant to a plea agreement, Raysheen Sharp pled guilty to a charge of conspiracy to make, utter, and possess counterfeit and forged securities. Sharp was subsequently sentenced to 33 months of imprisonment and ordered to pay restitution in the amount of $49,599.74. On appeal, Sharp argues that: (1) he is entitled to be resentenced pursuant to United States v. Booker, 543 U.S. 220 (2005), (2) the district court failed to follow Shepard v. United States, 544 U.S. 13 (2005), in calculating his criminal history category, and (3) the district court abused its discretion in calculating the amount of restitution. Sharp does not challenge his conviction.
